DO YOU KNOW YOUR MOTOR VEHICLE CREDIT RIGHTS?

You have a legal right to “just say no” to a repo man and force the creditor to go to court where you can raise legal issues about your account.  If the creditor takes the car from you, over your verbal protest the creditor must pay you a cash penalty.  

You have a right to chain your vehicle to your carport or a tree to keep the repo man from taking it, and if he breaks the chain he must pay you a cash penalty.  

It is illegal for a policeman to assist a repo man in seizing your car or truck unless he also has a court order.  

In a motor vehicle sales finance transaction if your creditor does not send you a proper legal notice after repossession, informing you of your legal rights, the creditor cannot ask you to pay any more money if the vehicle does not bring enough at the sale to pay off the debt.  The same is true if he sends the notice, but it misinforms you about your rights or about the balance you must pay to redeem the vehicle before it is sold.  

If a creditor, after repossession of your car, tells you that you must redeem the vehicle by a certain date, you don’t have to pay any more money if the vehicle does not sell for the amount of the debt, because they must give you up until the date it is actually sold to redeem it.  

In a consumer transaction, if the creditor violates any of the Uniform Commercial Code rules of repossession they must pay you, or credit your account, an amount equal to at least the whole finance charge plus 10% of the cash price of the car.  

If a car dealer breaks a promise made in a car purchase contract, and the contract has been sold to a finance company, you can raise the same claims and defenses against the finance company that you could have raised against the dealer.  

If you borrow money from a bank or credit union specifically to buy a car, and the car is pledged to secure the loan, and the dealer does not live up to the terms of the sale, you can raise that breach of contract against the bank or credit union that financed the deal.  

Credit Life insurance on car loans.  If your husband had credit life insurance on his truck account at the time of his death you can not only get the truck paid off but probably get cash money from the insurance company as well.  If he died in a truck accident you can collect on both the truck insurance and the life insurance.
